COMPETITION TERMS AND CONDITIONS

 

By entering the giveaway from WeddingsWhitsundays.com (WW.com), you agree to the terms.

  1. You agree to comply with the requests of the person/s operating this event on behalf of WW.com
  2. WW.com has taken reasonable care in arranging this program and has relied on information provided by venue or services operators and accepts no responsibility for the accuracy or completeness of that information.
  3. It is mandatory for you to conduct yourself in a responsible, respectful and professional manner throughout the competition, including after the wedding date in relation to all aspects of the competition.
  4. You understand this is a game / competition of skill. Chance plays no part in determining the winner. Each entry will be individually judged.
  5. Winner will be selected by a panel of representatives from the Whitsundays wedding industry and applications will be judged on content, creativity, originality and understanding of the Whitsunday region.
  6. If, despite every reasonable effort, we cannot contact a prize winner, or the prize winner is unable to accept the prize, or the prize winner is not eligible to win, we will retain the prize for 1 week after the draw. At the end of 1 week if the prize remains unclaimed or voided, the promoter will deem the runner up as the new winner.
  7. All entrants who choose to ‘opt-in’ consent to have their contact details (first name, email and post-code only), released to Weddings Whitsundays, Paradise Cove Resort and The Wedding Planners Whitsundays and receiving ongoing marketing material and correspondence.
  8. You authorise WeddingsWhitsundays.com and its relevant third parties, including all suppliers participating in the giveaway competition, to use the photographs obtained / videotaping taken / audio recorded / quotes obtained of you during the activities (from the time you enter until after the wedding date), for all publicity and marketing purposes including but not limited to publications, promotional flyers, news articles, websites, newsletters, e-newsletters, presentations, books and magazines, on a free-of-charge, royalty free and worldwide use basis in perpetuity. No future consent is required.

 

To participate in this giveaway competition, you must:

  8. Not be an employee, member or immediate family of WeddingsWhitsundays.com or any suppliers/vendors associated with the giveaway.
  9. By entering the giveaway competition, you agree to the terms and conditions.

WeddingsWhitsundays.com have the right to:

  1. Refuse materials that do not meet the participation terms and conditions.
  2. Ensure there is an adequate mix of operators featured.
  3. Cancel or modify wedding giveaway components as seen fit.
  4. Withdrawal or amend the competition as necessary due to circumstances outside its control.
  5. Substitute any component of the prize for an itinerary of equal value at their discretion.

WW.com, Paradise Cove Resort and/or The Wedding Planners Whitsundays accept no liability for any loss or damage suffered by any individual or company arising from or in any way connected with acts, incidents and occurrences happening in the lead up to and after the wedding to any registrant whether such acts, omissions, incidents and occurrences occur at the event or at any points in between. The applicant must indemnify TW and its officers in respect to any claim which he or she may have arising in any way from their registration or participation as a member of the giveaway or event to the nominated market. The provision of your personal information is voluntary but is necessary to determine your suitability for participation in the WeddingsWhitsundays.com Wedding Giveaway.

WEDDING PACKAGE TERMS AND CONDITIONS

A. PACKAGE INCLUSIONS

  1. Wedding giveaway package inclusions are not redeemable for cash or interchangeable for other products or services.
  2. Individual supplier(s)/vendor(s) may require separate signed terms and conditions once the winner is chosen before proceeding with fulfilment of their product or service. If the individual supplier terms and conditions are not signed or agreed to, the supplier/vendor has the right to refuse service. No refund or alternate product or service will be given in its place.
  3. A reduction in guest numbers, under 60, will not incur a refund or additional services at a reduce costs or no cost.

B. DEPOSITS AND PAYMENTS

  1. Additional non-refundable deposits may be requested for additional suppliers and/or services. All deposits are non-refundable.
  2. If additional products or services are added to your wedding package 50% of your estimated total contract price is due three months prior to the event.
  3. If additional products or services are added to your wedding package full balance of payment must be paid 1 month prior to the event.
  4. Acceptable methods of payment include credit card, direct deposit and cash. If cheque is required to pay for the balance, then the cheque must be received by The Wedding Planners Whitsundays a minimum of 35 days prior to the event.

C. CONFIRMATIONS

  1. Bookings including suppliers, services, venues and wedding date, cannot be confirmed until full deposit and completed booking from, including signed booking terms, are received and processed by The Wedding Planners Whitsundays.
  2. Bookings can take up to 14 business days to process from the time of receiving full deposit, completed booking forms and signed booking terms.
  3. Additional services cannot be booked and confirmed until written notification and full non-refundable deposit are received and processed.

D. ADDITIONAL FEE’S

  1. Additional fees may be charged for requests outside of what is included in the wedding giveaway package and/or additional products or services. If a request will incur additional fees this will be advised to you and approved by you, prior to The Wedding Planners or supplier/vendor proceeding with the request. All requirements must be confirmed by the client in the specified time frames given.
  2. Any work resulting from late advice from the client (based on given time frames), will be charged an additional $70 per hour.
  3. Any work in the final fortnight leading up to your wedding resulting from late advice from the client, will be charged an additional $140 per hour.
  4. Additional suppliers or inclusions will be at an additional cost payable to The Wedding Planners Whitsundays one month prior to the event date.
  5. Additional attendees will be at an additional cost payable to The Wedding Planners Whitsundays one month prior to the event date.

E. CANCELLATION POLICY

  1. In the event of cancelling requirements with The Wedding Planners Whitsundays with more than three months’ notice the non-refundable deposit (if applicable for additional services) will be retained along with any other amount charged by The Wedding Planners, to cover work to date or additions added to your package, at the discretion of The Wedding Planners Whitsundays. Any additional money paid towards your wedding contract price will be reimbursed.
  2. In the event of cancelling requirements with The Wedding Planners Whitsundays with less than three months’ notice but more than one-month notice, the non-refundable deposit and non-refundable progress payment will be retained along with any other amount charged by The Wedding Planners, to cover work to-date or additions added to your wedding package (i.e. accommodation), at the discretion of The Wedding Planners Whitsundays. Other suppliers booked in conjunction with your package may also pass on cancelation fees of their choice. Any additional money paid towards your wedding contract price will be reimbursed.
  3. In the event of cancelling requirements with The Wedding Planners Whitsundays with less than one-month notice, the total amount of your booking will be retained.
  4. If payment is not received within 7 business days of scheduled payment terms The Wedding Planners Whitsundays will consider this a cancellation and cancel all venues, suppliers, locations, etc.
  5. If payment is yet to be made and you choose to cancel your event payment as per above schedule and advise is payable to The Wedding Planners Whitsundays within 7 days of cancelling. If payment is not made 10% surcharge of the balance will be added for each week the account goes unpaid.
  6. Rescheduling the date of the event within the above time frames may be considered a cancellation and the same fees and terms may apply. Leniency in cancellations fees for rescheduling of the event may be considered at the discretion of each venue and The Wedding Planners Whitsundays.

F. LIABILITY

  1. The client agrees to indemnify WeddingsWhitsundays.com, Red Cat Adventures and The Wedding Planners Whitsundays and hold harmless from and against all damages, costs, actions, claims and demands that may be sustained or suffered or recovered against The Wedding Planners Whitsundays, it’s employees and agents by the client or any other person.

G. ACCOMMODATION

  1. By agreeing to these booking terms you are also agreeing to Pinnacles Resort and Paradise Cove Resort’s accommodation’s terms and conditions.
  2. A credit card will be required upon check in to any accommodation as a security deposit.
  3. All additional fees/charges are payable directly to the accommodation.
  4. Persons under the age of 18 years old are not permitted to stay overnight at Paradise Cove and must be departed the property by 11pm.

H. MAXIMUM NUMBERS

  1. The giveaway competition wedding package includes 60 guests (adults or children, including the winning couple)
  2. Additional guests can be accommodated for at an additional per person charge, subject to venue approval.
  3. Aircraft (seaplane) has an overall weight payload limit as well as an individual seat weight payload limit which must be adhered to. Individual passenger weights must be supplied at least one month prior to the wedding date.

I. CONFIRMATION OF ATTENDEES

  1. Final number of attendee’s must be confirmed at least one month prior to the event. A reduction in numbers after this time will not attract a refund of competition giveaway inclusions or additional inclusion/s at a cost to the client added to the wedding package.
  2. An increase in attendees after confirmation of final numbers will be accommodated where possible although no guarantee can be made that such accommodations can be made. Additional guests will incur an additional fee and are subject to venue approval.

J. MENU

  1. Menus are subject to change at the discretion of Paradise Cove Resort, D’vine catering and/ or The Wedding Planners Whitsundays.
  2. Special dietary requirements can be catered for provided adequate notice is given to your wedding planner; this notice should be provided no later than one month prior to your event. Special dietary requirements cannot be accommodated on the day of your wedding without prior notice.
  3. Standard dietary requirements (i.e. vegetarian, gluten free, nut allergy, etc) are catered to free of charge. Dietary requirements where additional ingredients, not normally purchased by the caterer, are required an additional fee will be charged. The client will be advised of the costs and must provide written approval of the ingredients/menu items and costs involved before these ingredients will be purchased and used.
  4. D’Vine Catering make every attempt to identify ingredients that may cause allergic reactions for those with food allergies. However, there is always a risk of contamination. There is also a possibility that manufacturers of the commercial ingredients used could change the ingredients at any time, without notice. Clients concerned with food allergies need to be aware of this risk. D’vine Catering, Paradise Cove Resort and/or The Wedding Planners Whitsundays will not assume any liability for adverse reactions to food and drink served or consumed at the event.

K. NOISE LEVELS

  1. Noise levels of your event must be in accordance with each Paradise Cove Resort’s noise restrictions.
  2. Paradise Cove Resort and/or The Wedding Planners Whitsundays reserve the right to regulate the volume of performers, the noise of the guests and refuse the use of instruments such as (not limited to) drums, whistles and amplification devices.

L. SECURITY

  1. We reserve the right to require security personnel at a cost to the client if deemed necessary.
  2. Paradise Cove Resort, Red Cat Adventures, D’vine Catering and/or The Wedding Planners Whitsundays, in accordance with Liquor Licensing laws and Responsible Service of Alcohol laws, reserves the right to refuse the service of alcohol to any guest it considers being under age, intoxicated, is without suitable identification or is behaving in an offensive manner.
  3. Venue management and/or The Wedding Planners Whitsundays reserves the right to request attendees leave the venue premises and grounds if they are deemed by management to be excessively noisy, intoxicated, and abusive or in contravention of liquor licensing laws and Responsible Service of Alcohol laws.

M. PROPERTY DAMAGE AND THEFT

  1. Any damage caused to the venue, equipment or resort and/or if additional cleaning is required as a direct result of your event or event guests you will be charged accordingly.
  2. WeddingsWhitsundays.com, Paradise Cove Resort, The Wedding Planners Whitsundays and all participating suppliers do not take any responsibility for damage or loss of attendees’ items before, during or after a function. Nor does management take any responsibility for loss or damage relating to items belonging to external suppliers.
  3. The use of glitter, confetti, diamantes, beads, and crystals will incur an additional cleaning fee of $2,000 charged to the client.
  4. Excessive dirt or staining of any linen and/or chair covers not deemed by Paradise Cove Resort and/or The Wedding Planners Whitsundays to be acceptable in the normal course of a function will incur an additional cleaning or replacement fee charged to the client.
  5. Payment for damages is due within 7 days of notice given. Payment can be made via credit card and attract a further 2% fee or by direct deposit.

N. EVENT SET UP AND SUPPLIERS

  1. The Wedding Planners Whitsundays requires advance written notice by the client of suppliers being used for event set-up or during the event.
  2. All suppliers being used for your event must hold current public liability certificate. This can be requested at any time and is the responsibility of the client to ensure each supplier is adequately insured with public liability.
  3. We reserve the right to deny permission for services that pose potential damage to our property or violate our lease terms. WeddingsWhitsundays.com, Paradise Cove Resort and The Wedding Planners Whitsundays accepts no responsibility for the services provided by suppliers/vendors regardless of their participation with the competition giveaway package.

O. EVENT TIMINGS

  1. Supplier access to Paradise cove is from 9am on Friday 3rd August 2018. Patron access to Paradise Cove is from 12pm on Friday 3rd August 2018, unless otherwise approved by venue management. Patron departure from Paradise Cove (non-overnight guests) must be no later than 11pm on Friday 3rd August 2018. Parton departure from Paradise Cove (overnight guests) must be no later than 9am on Saturday 4th August 2018. Supplier departure (along with all pack down) of Paradise Cove must be no later than 12pm on Saturday 4th August 2018.
  2. Paradise Cove Resort and The Wedding Planners Whitsundays will do its best to accommodate functions that start after the contracted time due to tardy arrival or delays on the part of the client or guests.
  3. Please have attendees arrive at the scheduled time to ensure the best service and adherence to the contracted event schedule.
  4. Events that exceed the agreed event finish time will be at the discretion of the venue and/or The Wedding Planners Whitsundays in terms of additional service fees or forced conclusion of the event.

P. UNFORESEEN CIRCUMSTANCES

  1. If your coordinator is unable to fulfil booked duties due to unforeseen circumstances out of the control and not by fault of The Wedding Planners Whitsundays no refund will be given.
  2. In the case of forced changes to venue, supplier and/or service due to weather or for any other reason, a new pricing structure will be advised to accommodate revised venue, supplier and/or service. Forced changes could be more or less than the original booking.
  3. Any additional costs associated with unforeseen circumstances and/or forced venue change, regardless of fault or reason, will be the sole responsibility of the client. Any additional payment/s will be required prior to commencement of further planning and/or events.
  4. Availability and price of revised products and services are not guaranteed until client has confirmed in writing.
  5. WeddingsWhitsundays.com, Paradise Cove Resort and/or The Wedding Planners Whitsundays do not take responsibility for any forced changes and/or additional fees incurred as a result.

Q. INCLEMENT WEATHER / CHANGE OF VENUE (DÉCOR)

  1. In the event of inclement weather preventing you from having your requested location, the decoration supplier and/or The Wedding Planners Whitsundays will endeavour to relocate your requested décor to your alternate location and/or provide other suitable décor to equal value of your order. Each case will be assessed on an individual basis by reference to the preparation involved and time-frame given for relocation. If not all booked décor is able to be used a refund will not be applicable.
  2. The decoration supplier and/or The Wedding Planners Whitsundays retain the right to cancel decoration on the day, should conditions deem the decoration unsuitable for use.

R. LOSS/DAMAGES (DÉCOR)

  1. All items remain the property of the decoration supplier and/or The Wedding Planners Whitsundays and clients will be charged for loss or damage of any items (except for those listed as items for purchase – candles, flower scatters and bonbonniere). The payment for loss or damage of any items must be finalised within one month of the event date.
  2. Some choices on your part that may play a part in irreparable or excessive damage to the decorator supplier’s property may include and are not limited to; choosing an outdoor function in the influence of wind, rain and natural elements or the use of sparklers, matches and cigarettes near decoration.

If any portion of these fore-written booking terms are not met, WeddingsWhitsundays.com, Paradise Cove Resort and/or The Wedding Planners Whitsundays retain the right to refuse service.
